These Terms of Service (“Terms”) are an agreement between you and Alexander Handley (“we”, “us”, or “our”) governing your use of the Better Skin mobile app and the website at betterskinapp.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
Important. Better Skin is a wellness journaling companion. It does not diagnose, treat, or provide medical advice, and its responses are generated by AI and can be wrong. Always consult a qualified healthcare professional or dermatologist about any health concern.
1. Who can use the Service
You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you give us is accurate.
2. What the Service is
Better Skin helps you keep a short daily check-in about your skin, diet, sleep, and stress, and reflects patterns back to you over time through AI-generated openers, summaries, and “Readings”. It is intended for general wellness and self-reflection only.
The Service is not a medical device, a healthcare service, or a substitute for professional advice, diagnosis, or treatment. It does not diagnose or treat any condition. If you think you may have a medical concern, or if a symptom is new, persistent, or changing, seek advice from a qualified healthcare professional or dermatologist. If you think you may have a medical emergency, contact your local emergency services.
3. AI-generated content
Much of what the Service shows you is generated by AI based on the information you provide. It may be inaccurate, incomplete, or not suited to your situation. You are responsible for how you choose to act on it, and you should use your own judgement and seek professional advice where appropriate. We don’t guarantee any particular result or outcome.
4. Your account
You’re responsible for keeping your account credentials secure and for activity that happens under your account. Let us know promptly if you believe your account has been accessed without your permission. You may delete your account at any time from within the app.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of these Terms;
- attempt to access accounts or data that aren’t yours, or interfere with the security or operation of the Service;
- copy, reverse-engineer, scrape, or attempt to extract the source code or underlying models of the Service, except to the extent the law allows;
- resell, rent, or commercially exploit the Service without our permission; or
- upload content that infringes others’ rights or that is unlawful.
6. Your content
Your journal entries and profile information are yours. You grant us a limited licence to store, process, and transmit that content as needed to operate and provide the Service to you — including sending it to our AI provider to generate responses — as described in our Privacy Policy. We don’t claim ownership of your content.
7. Subscriptions and billing
Some features require a paid subscription. Subscriptions are sold as auto-renewable in-app purchases through the Apple App Store, and billing is handled by Apple under your Apple Account. We use RevenueCat to manage your subscription and unlock your paid features.
- Payment is charged to your Apple Account at confirmation of purchase.
- Your subscription automatically renews for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings after purchase.
- The current price and billing period are shown in the app before you purchase.
Payments are generally non-refundable except where required by law, including under the Australian Consumer Law. Because Apple processes the payment, we are not able to issue refunds for App Store purchases directly; you can request a refund from Apple at reportaproblem.apple.com, and refunds are granted in accordance with Apple’s policies.
8. Intellectual property
The Service, including its software, design, and content (other than your content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use in line with these Terms.
9. Third-party services
The Service relies on third-party providers (such as Apple, our hosting, AI, and analytics providers). Your use of the Service may also be subject to Apple’s terms. We’re not responsible for third-party services we don’t control.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We don’t warrant that the Service will be uninterrupted, error-free, or that any observation it surfaces is accurate or suitable for you.
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, it is limited to resupplying the Service or paying the cost of having it resupplied.
11. Limitation of liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law section above, we will not be liable for any indirect, incidental, special, or consequential loss, or for loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or AUD $100.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we need to for legal, security, or operational reasons. If we terminate or suspend your access without cause while you have an active paid subscription, you may keep using your paid features until the end of your current billing period, or request a refund for the unused portion from Apple. Sections that by their nature should survive termination — such as content licences, disclaimers, and limitations of liability — will continue to apply.
13. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. When we change these Terms, we’ll update the “Last updated” date above, and for material changes we will give you reasonable notice — for example, an in-app notice — before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. Nothing in this section limits any rights you have under the Australian Consumer Law.
